Budget 2011 - IR35 to stay

Following the recent OTS interim report, which provided three alternatives for IR35, in today's Budget, the Government has decided to retain the IR35 rules, but with a commitment to make clear improvements into the way the legislation is administered.

The main reason being that abolishing IR35 would "put substantial revenue at risk".

According to the Budget documentation (PDF - Page 70);

"These improvements will include setting up a dedicated helpline staffed by specialists, publishing guidance on those types of cases HMRC view as outside the scope of IR35, targeting compliance activity by restricting reviews to high risk cases and setting up an IR35 Forum which will monitor HMRC's new approach."
